How are IR1 and CR1 different? Instructions for tracking spouses' immigration records to the US

IR1 and CR1 are both immigrant visas for spouses of US citizens.

This is an Immediate Relative group so there is no limit on the number of annual visas like the Family Preference categories.

However, IR1 and CR1 are not exactly the same.

The important difference lies in how long the couple has been married at the time the sponsor becomes a permanent resident.

WHAT IS IR1?

IR1 is a visa for the spouse of a US citizen when the marriage has lasted 2 years or more at the time the sponsor is granted permanent residency.

WHAT IS CR1?

CR1 is a visa for a spouse when the marriage is less than 2 years old at the time the sponsored person becomes a permanent resident.

The letter C in CR1 can be understood as Conditional, which means permanent resident with conditions.

Therefore, you should not only look at the date USCIS receives the application to determine whether the application will be IR1 or CR1.

The important milestone is the moment the sponsored person becomes a permanent resident.

ARE IR1 AND CR1 TWO DIFFERENT PROFILES?

This is still a US citizen's spouse sponsorship application.

The main difference is that permanent resident status is granted based on the length of the marriage.

An application may start out being called a CR1 but then circumstances change so that the classification at the time of visa issuance needs to be reconsidered.

USCIS processes the petition.

WHY IR1/CR1 DOESN'T NEED TO WAIT FOR BULLETIN VISA LIKE F2B OR F4?

This is a very important point.

Spouses of US citizens fall under the Immediate Relative category.

This group is not limited in the number of annual immigrant visas like the Family Preference categories.

Therefore, IR1/CR1 applicants do not need to follow the Priority Date in the same way as F2B, F3 or F4 to wait for the visa number to become available.

However, that does not mean the application will be issued a visa immediately after the I-130 is approved.

The application must still complete NVC's processing steps, prepare documents, complete DS-260, meet interview requirements and other requirements.

“Immediate Relative” does not mean “immediate interview”.

After USCIS approves the petition, the file is transferred to the Department of State for further visa processing if subject to consular processing.

NVC will create a profile in the system and send a Welcome Letter when the profile is established.

The applicant then uses the information in the Welcome Letter to access CEAC.
